We wish to thank you for trusting MondayToo.
These General Terms and Conditions of Sale will clarify your legal rights
during your visit and purchases on the MondayToo website.
By accessing mondaytoo.com, you agree to a lawful commitment and to
complying with the provisions and conditions below. These General Terms and
Conditions apply to all Mondaytoo offers, orders and agreements to the
exclusion of any other general terms and conditions.
An item offered on the MondayToo website
All items offered by MondayToo are described as fully as
possible in good faith. The offers and prices are valid on the date they are
offered on our website. The prices include VAT and any recycling fee (Recupel).
MondayToo shall not be held liable for any (printing) errors
appearing in its offers.
We offer our products on our website until our supply is depleted. MondayToo
will do its utmost to have all your ordered items available. It may happen,
however, that an item is out of stock; in which case we will inform you as soon
as possible and you have the right to decide to cancel your order.
MondayToo shall not be held liable for any losses incurred as a result of
the unavailability of an item.
Agreement between you and MondayToo
The receipt by MondayToo of your order confirmation on its website
constitutes a valid agreement between you and MondayToo.
However, MondayToo may decide to subject the validity of the agreement to
other conditions, in the event, for example, of major orders or deposits,
orders placed by minors or if previous orders have not been paid.
In compliance with the law on trade practices, losses/damages are charged to
the seller. To this end you are to inform us within an acceptable period (2
weeks) after having received a shipment confirmation via e-mail or through your
order status on the website. MondayToo reserves the right to reject your
request if it does not reach us within this period.
Your right to return the order within 7 days of receipt
The Belgian law on trade practices and the information and protection of
consumers of 14th of July 1991 allows the purchaser to inform the
seller that he decided not to proceed with purchase ( mail to thomas@mondaytoo.com only) within 7
working days of receipt of the item. The goods must follow (unopened) within an
acceptable period after this announcement (e.g., 3 working days).
If you wish to return an item because you have changed your mind, you can do
so within 7 days of receipt. We will refund your order as soon as we have
received the returned item. You will have to pay for the shipping fees to
return the item.
If the item you receive is different from the item ordered, or if it arrives
damaged, please return it within 7 days of receipt. Upon receipt of the
returned item, we will refund your order as well as your shipping fees. Only
the shipping charges for the return via regular post will be refunded.
MondayToo reserves the right to reject returned items or refuse a refund if
the items have been damaged by the customer. If the item was sold and sent in a
sealed package the right to return may be excluded if the item is returned with
the seal broken .
Rejection of responsibility and limitation of liability
MondayToo cannot guarantee that mondaytoo.com will operate uninterruptedly
or perfectly. MondayToo does not provide guarantees with respect to the results
potentially obtained by using mondaytoo.com or to the accuracy or reliability
of the information gleaned through mondaytoo.com
This website is made available by MondayToo on an "as is" and
"as available" basis. MondayToo does not make statements or does not
provide any guarantees, clearly or implicitly, in connection with the operation
of the website, information, content, materials or products shown on this
website.
All MondayToo offers are free of obligations and valid while supplies last. MondayToo
expressly reserves the right to change the prices.
Insofar as allowed by law, MondayToo declines any guarantee, clearly or
implicitly, including but not limited to implicit guarantees or saleability and
suitability for a specific purpose. MondayToo shall not be held liable for any
damage resulting from the use of its website, including but not limited to
direct, ensuing or indirect losses.
Applicable legislation and competent jurisdiction
Belgian law applies. The courts of the judicial district of Nivelles (Belgium)
shall be solely competent in the event of disputes.
Language of the agreement
MondayToo is available in French and English. You can make your choice
during your first visit or by clicking on a language on the MondayToo homepage
in the top right corner. The language you choose is also the language used for
the transactions and any further communication between you and MondayToo.
